Scope and Acceptance

These General Terms and Conditions (hereinafter "GTC") regulate the access and use of the website www.bazzicus.com (hereinafter "the Site") and Bazzicus's online store, as well as all purchases, contracts, and transactions made through it. The GTC should be read in conjunction with the Privacy Policy and Cookie Policy, also available on the Site.

By accessing the Site and/or placing an order, the User declares to have read, understood, and fully accepted these GTC. If the User does not agree with them, they must refrain from using the Site or making any purchase. Bazzicus reserves the right to change these GTC at any time, with the current version always being the one published on the Site with its respective update date.

The use of the Site also implies that the User is 18 years of age or older and has full legal capacity to enter into binding contracts. The elements and information transmitted by the User have full legal effects, and the User cannot invoke the absence of a signature to evade assumed obligations.

Identification of the Site Owner

The Site is owned and operated by Bazzicus, located at Rua Eng. Adelino Amaro da Costa, nº 10, 4640-141, Baião, Portugal, with the electronic contact bazzicus.info@gmail.com. Bazzicus is the entity responsible for making the online store available and for concluding purchase and sale contracts with Users.

Site Access and Account Registration

Access to the Site is free of charge, without prejudice to the internet connection costs borne by the User with their telecommunications provider. In general, no prior registration is required to consult the Site, although the User may choose to create an account to benefit from a more convenient shopping experience.

In case of registration, the User undertakes to provide true, accurate, complete, and updated information, being entirely responsible for the security and confidentiality of their access credentials. Any access or operation carried out with the User's credentials is their exclusive responsibility, and they must immediately notify Bazzicus in case of unauthorized use of their account. Bazzicus reserves the right to cancel accounts that contain false, incomplete, or non-existent identity data.

Site Usage Rules

The User undertakes to use the Site, its contents, and services in accordance with the law, morality, public order, and these GTC, refraining from any unlawful use or infringement of third-party rights. In particular, it is expressly prohibited to introduce or disseminate content of a racist, xenophobic, pornographic nature or that violates human rights; to transmit computer viruses or any harmful software likely to damage third-party systems; to disseminate false or misleading information; to impersonate other users; or to violate intellectual or industrial property rights of Bazzicus or third parties.

The User may not attempt unauthorized access to the Site, the server where it is hosted, or any database or system connected to it. Any violation of these rules will be reported to the competent authorities, with whom Bazzicus will fully cooperate. The User also undertakes to hold Bazzicus harmless from any claims, fines, or penalties resulting from the breach of their obligations, and Bazzicus reserves the right to demand compensation for damages suffered.

Products, Availability and Prices

Product information

Bazzicus will make every effort to ensure that the information presented on the Site regarding its products — including descriptions, images, features, and prices — is accurate and up-to-date, committing to promptly correct any errors detected. Product images are for illustrative purposes only, and there may be slight variations in color or presentation compared to the product actually delivered, which does not constitute a defect.

All orders are subject to stock availability. If an ordered product is unavailable after the order confirmation, Bazzicus will contact the User by email or phone to propose alternatives or, if not possible, to proceed with a full refund of the amounts already paid.

Prices and VAT

All prices published on the Site include Value Added Tax (VAT) at the legal rate in force in Portugal, unless expressly stated otherwise. Shipping costs are presented separately during the order process and added to the total amount before payment confirmation. Bazzicus reserves the right to change prices at any time, with the price applicable to each order being the one in force at the time of its confirmation.

If, due to a technical or typographical error, a product is published with an incorrect price, Bazzicus is not obliged to supply it at that price. In such a situation, the User will be informed and may choose to confirm the order at the correct price, cancel it with a full refund, or, if the correct price is lower than indicated, receive a refund of the difference.

Purchase Process and Contract Conclusion

To purchase a product on the Site, the User must select the desired item, choose the available options (size, color, quantity), and add it to the shopping cart. After confirming the items in the cart, the User must provide delivery details and select the desired payment method. If the User has a discount coupon, they must enter it in the designated field before finalizing the order, as it will not be possible to claim the respective discount after the order confirmation.

The purchase and sale contract is considered concluded when Bazzicus sends the User an order confirmation email, containing the order number, the purchased products, the total amount, and the estimated delivery time. If the User does not receive this email within 24 hours of purchase, it is recommended to check the spam folder or contact Bazzicus. The User should keep this confirmation receipt.

Bazzicus reserves the right not to accept or to cancel orders in case of product unavailability, suspicion of fraudulent activity, inconsistency in the data provided, or obvious error in the price or product description. In these cases, the User will be informed, and any payments already made will be fully refunded.

Payment Methods and Conditions

The User may pay for their purchases through the following methods available on the Site: credit or debit card (Visa, Mastercard), Multibanco, MBWay, and bank transfer. All payments are processed through SSL encryption systems that guarantee the security of transactions.

In the case of payment by bank transfer, the necessary details will be indicated in the order confirmation email. The order will only be processed after the full amount has been received in Bazzicus's account, and the transfer request is valid for 48 hours. Any payment made beyond this period may be subject to changes in product availability. The User confirms that the payment methods used are their own and that they are duly authorized to use them. Bazzicus cannot be held responsible for delays or payment refusals attributable to the card issuing entity or the banking institution.

Order Delivery

Deadlines and modalities

Orders will be delivered to the address indicated by the User in the order form. Order processing may take up to 48 business hours after payment confirmation. Estimated delivery times for mainland Portugal are 2 to 5 business days; for the Autonomous Regions of the Azores and Madeira, between 5 to 10 business days; and for international shipments, between 3 to 10 business days for Europe and up to 25 business days for other destinations, these deadlines may vary depending on the carrier and applicable customs procedures.

Shipments are carried out through partner carriers, such as CTT, DPD or DHL, depending on the destination and the characteristics of the order. Shipping costs are presented to the User before order confirmation and are their responsibility, unless expressly stated otherwise by Bazzicus.

Reception and verification

Upon receipt of the order, the User must check the condition of the packaging and products. If the packaging shows visible damage, it is recommended that the User refuse delivery or sign the transport guide with express reservation, then contact Bazzicus. Bazzicus is not responsible for non-delivery when it results from incorrect or insufficient information provided by the User, nor for circumstances beyond its control, such as the absence of the recipient at the time of delivery.

International deliveries and customs charges

For orders destined outside Portugal, import taxes, customs duties, or other fees may be applied by the destination country, which are the sole responsibility of the User. Bazzicus recommends that the User inquire with local authorities about applicable charges before making a purchase. Product values may be presented in different currencies, but all transactions are processed in Euros.

Order Cancellation

The User may request the cancellation of their order as long as it has not yet been processed, by contacting Bazzicus via bazzicus.info@gmail.com and indicating the order number and associated NIF. After processing begins, Bazzicus will attempt to deliver, and the User may exercise their right of free resolution under the terms described in the following section.

Bazzicus reserves the right to cancel orders whenever it detects inconsistencies in User data, suspicion of fraud, technical errors in prices, or subsequent unavailability of products. In these cases, the User will be informed, and any amount paid will be fully refunded.

Right of Free Resolution

Under Article 10 of Decree-Law no. 24/2014, of February 14, the User acting as a consumer has the right to freely resolve the purchase contract within 14 calendar days from the date of receipt of the goods, without needing to state any reason and without incurring additional costs, except those expressly provided by law.

To exercise this right, the User must notify Bazzicus, before the end of the 14-day period, of their unequivocal intention to resolve the contract, via bazzicus.info@gmail.com or by letter sent to Rua Eng. Adelino Amaro da Costa, nº 10, 4640-141, Baião, Portugal, identifying the order number. After communicating the resolution, the User must return the goods within a maximum of 14 days, in perfect condition, without signs of use beyond simple testing, with intact labels, in their original packaging, and accompanied by the respective invoice. Return costs are generally borne by the User.

Bazzicus will refund the amounts paid, including initial delivery costs (except additional costs resulting from choosing a shipping method other than the most economical), within a maximum of 14 days after receiving the communication of resolution or the return of the goods, whichever occurs last. The refund will be made by the same payment method used in the purchase, unless expressly agreed otherwise.

The right of free resolution does not apply, among other cases, to goods manufactured according to consumer specifications or clearly personalized, to sealed goods that cannot be returned for reasons of health protection or hygiene when opened after delivery, nor to goods which, by their nature, become inseparably mixed with other items after delivery.

Legal Warranty of Conformity

All products sold by Bazzicus benefit from the legal warranty of conformity provided for in Decree-Law no. 84/2021, of October 18, for a period of 3 years from the date of delivery. A good is considered not to be in conformity when it does not correspond to the agreed description or characteristics, is not suitable for the purpose for which it was purchased, or does not present the usual quality and performance of goods of the same type.

In case of lack of conformity, the User has the right, at their choice, to repair or replace the good, a proportional reduction in price, or the resolution of the contract with a full refund, unless the chosen solution is impossible or disproportionate. It is presumed that non-conformities manifested within the first two years after delivery already existed at the time of delivery. To report a defect or non-conformity, the User must contact Bazzicus via bazzicus.info@gmail.com, indicating the order number, a description of the problem, and, whenever possible, illustrative photographs.

Voluntary Exchanges

In addition to the legal rights described above, Bazzicus accepts voluntary exchanges within 15 days of receipt of the goods, provided that the item is in the same condition as delivered, without signs of use, with original labels and packaging intact, and accompanied by the purchase invoice. Shipping costs associated with voluntary exchanges — not due to lack of conformity — are the responsibility of the User.

To request an exchange, the User must contact Bazzicus via bazzicus.info@gmail.com, indicating the order number and the item they wish to exchange. After receiving and verifying the condition of the returned product, Bazzicus will process the exchange within 3 to 5 business days. If it is not possible to exchange for the desired product, the User will be offered the possibility to choose an alternative item or, as a last resort, to receive a refund of the amount paid.

Exclusion and Limitation of Liability

Bazzicus is not liable for damages suffered by the User resulting from failures or interruptions in telecommunications networks or computer systems, from viruses or other harmful elements introduced by third parties, nor for any errors or inaccuracies in the information made available by third parties through external links present on the Site. The existence of hyperlinks to other websites does not imply any recommendation or responsibility of Bazzicus for the content of these sites, which are the sole responsibility of their owners.

Bazzicus does not guarantee that the Site will be permanently available, free of errors or interruptions, committing, however, to restore its operation as soon as possible in case of an incident. Bazzicus will also not be responsible for indirect damages, loss of profits, or other consequential losses resulting from the use of the Site or purchased products, except when such liability arises from a mandatory legal provision.

In situations of force majeure — understood as extraordinary and unforeseeable circumstances beyond Bazzicus's control, such as natural disasters, pandemics, strikes, acts of public authority, or infrastructure failures — Bazzicus is exempted from its obligations during the period in which these circumstances persist, benefiting from an equivalent extension of compliance deadlines.

Intellectual and Industrial Property

All content on the Site — including texts, photographs, images, graphics, icons, software, source code, graphic design, trademarks, and logos — is the intellectual property of Bazzicus or third parties who have authorized its use, and is protected by applicable national and international legislation, namely the Copyright and Related Rights Code and the Industrial Property Code.

No content on the Site may be reproduced, distributed, transmitted, transformed, or used for commercial purposes without the prior and express authorization of Bazzicus. Access to the Site does not confer on the User any right over Bazzicus's trademarks, trade names, or other distinctive signs. The User who publishes or authorizes the publication of content on the Site declares to hold the respective intellectual property rights and undertakes to hold Bazzicus harmless from any third-party claims in this regard.

Privacy and Data Protection

The processing of Users' personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and Law no. 58/2019, of August 8. For detailed information on the purposes of processing, User rights, and how to exercise them, please consult our Privacy Policy, available on the Site. By using the Site, the User consents to the processing of the information provided as described therein.

Communications

All communications and notifications related to the order or these GTC will be sent to the email address provided by the User at the time of purchase or registration. The User agrees to receive these communications electronically, and may at any time request to unsubscribe from newsletters or promotional communications through the link available in each message or by direct contact with Bazzicus.

Dispute Resolution and Applicable Law

These GTC are governed by Portuguese law. In case of dispute, the User may resort to Alternative Dispute Resolution (ADR) entities, under Law no. 144/2015, of September 8, namely the Porto Consumer Conflict Arbitration Center (www.cicap.pt) or the Lisbon Consumer Conflict Arbitration Center (www.centroarbitragemlisboa.pt). More information is available on the Consumer Portal at www.consumidor.gov.pt.

For disputes arising from e-commerce contracts, the User may also resort to the European online dispute resolution platform (ODR), available at https://ec.europa.eu/consumers/odr. Without prejudice to recourse to alternative dispute resolution methods, the competence of the Portuguese Courts is recognized for the assessment of any disputes arising from these GTC.

General Provisions

If any clause of these GTC is declared null, invalid, or ineffective, this will not affect the validity of the remaining provisions, which will remain in full force. The non-enforcement by Bazzicus of any obligation provided for in these GTC does not constitute a waiver of the respective right, which may be exercised at any time.

These GTC constitute the entire agreement between Bazzicus and the User regarding the use of the Site and purchases made through it, replacing any previous agreements on the same matters. Bazzicus reserves the right to change these GTC at any time, and the changes will take effect from the date of their publication on the Site. Continued use of the Site after that date implies acceptance of the GTC in the version then in force.
