General Terms and Conditions of Sale (English Version)

Introduction

By placing an order on www.bazzicus.com, the Customer agrees to purchase a Product in accordance with these terms and conditions of Bazzicus, hereinafter referred to as “General Terms and Conditions of Sale”.

These Conditions always apply between the Customer and Bazzicus when using or placing an order through the website (hereinafter referred to as the “Site”).
We recommend that you read them carefully and keep a copy for future reference.

Article 1 – Definitions

Site: the website www.bazzicus.com and all its subdomains.
Customer: the natural or legal person acting in the exercise of their profession or business who enters into an Agreement with Bazzicus.
Product(s): the items offered on the Site.
Agreement: any contract entered into between Bazzicus and the Customer, of which these Terms and Conditions form an integral part.
General Terms and Conditions of Sale: these terms and conditions of Bazzicus.

Article 2 – Applicability

2.1 These Conditions apply to all offers, orders, deliveries and Agreements concluded with Bazzicus, unless expressly agreed otherwise in writing.

2.2 Any conditions submitted by the Customer shall only be binding if expressly accepted in writing by Bazzicus.

Article 3 – Prices and Information

3.1 All prices shown include VAT at the legal rate in force, unless otherwise stated.

3.2 Shipping costs, where applicable, will be clearly indicated before the conclusion of the order.

3.3 Although the Site is compiled with the utmost care, errors or inaccuracies may occur. Bazzicus reserves the right to correct them at any time.

3.4 Colour differences between the images displayed on the Site and the actual Product may occur, and Bazzicus cannot be held responsible for such discrepancies.

Article 4 – Conclusion of the Agreement

4.1 The Agreement is considered concluded once the Customer accepts the offer made by Bazzicus, subject to these Conditions.

4.2 In case of electronic acceptance, Bazzicus will confirm by electronic means.

4.3 If the Customer provides incorrect information, Bazzicus may suspend its obligations until the correct data is received.

Article 5 – Performance of the Agreement

5.1 After confirmation, Products are delivered to the carrier selected by the Customer during the purchase process.

5.2 Bazzicus may engage third parties for the performance of the Agreement.

5.3 The Site provides estimated delivery times.

5.4 If delivery cannot be made within 30 days, the Customer will be informed and may either accept a new date or cancel the Agreement without additional costs.

5.5 Customers are advised to check Products upon delivery and report any defects within 2 working days.

5.6 Risk transfers to the Customer once the Products are delivered to the address provided.

5.7 If the ordered Product is no longer available, Bazzicus may provide a product of equivalent nature and quality. In such case, the Customer has the right to terminate the Agreement.

Article 6 – Right of Withdrawal / Returns

6.1 The Customer has the right to return the Product within 14 days from the delivery date.

6.2 The Customer must notify Bazzicus by e-mail, providing: order number, name, telephone, e-mail and delivery address. A Return Authorisation Number (RA) will then be issued.

6.3 Only unused Products, in perfect condition, in their original sealed packaging and accompanied by proof of purchase/shipping will be accepted.

6.4 Return shipping costs are borne by the Customer. Registered and insured shipping is strongly recommended.

6.5 Refunds will be issued within 14 days after receipt and approval of the returned Products.

Article 6-A – Outlet Products

6A.1 For Products purchased in the Outlet section, refunds are not permitted.

6A.2 In such cases, the Customer is only entitled to a size exchange, subject to stock availability.

6A.3 The provisions of Article 6 apply, with the necessary adjustments, to size exchanges of Outlet Products.

Article 7 – Payment

7.1 Payment must be made using the methods available on the Site.

7.2 Bazzicus reserves the right to change payment methods at any time.

Article 8 – Warranty and Conformity

8.1 Bazzicus guarantees that the Products correspond to their intended use and description on the Site.

8.2 The Customer must report any lack of conformity within 14 days of delivery.

8.3 Non-conforming Products may be repaired, replaced or (partially) refunded, by mutual agreement.

Article 9 – Complaints

9.1 Complaints must be submitted in writing or by e-mail using the contact details provided at the end of these Conditions.

9.2 Bazzicus will acknowledge receipt within 7 working days and provide a final response within a reasonable timeframe.

Article 10 – Liability

10.1 Bazzicus’ maximum liability towards the Customer is limited to the amount paid for the order in question (including VAT and shipping).

10.2 Bazzicus shall not be liable for indirect damages such as lost profits, data loss or business interruption.

10.3 These limitations do not apply in cases of intent or gross negligence attributable to Bazzicus.

10.4 Liability may only be claimed if the Customer notifies Bazzicus in writing, granting a reasonable period to remedy the breach, which remains unremedied.

Article 11 – Final Provisions

11.1 If any provision is deemed invalid, the remaining provisions remain in effect.

11.2 Portuguese law shall apply to these Terms and Conditions.

11.3 Any dispute shall be submitted to the courts of the district of Bazzicus’ registered office, without prejudice to mandatory consumer protection rules.
